The terms “competency” and “decision making capacity” are often used interchangeably in the medical setting. Although competency is a legal determination made by judges, “competency” assessments are frequently requested of psychiatrists who are called to consult on hospitalised patients who refuse medical treatment. In these situations, the bioethicist is called to consult frequently as well, sometimes as a second opinion or “tie breaker”. The psychiatric determination of competence, while a clinical phenomenon, is based primarily in legalism and can be quite (...) different from the bioethics approach. This discrepancy highlights the difficulties that arise when a patient is found to be “competent” by psychiatry but lacking in DMC by bioethics. Using a case, this dilemma is explored and guidance for reconciling the opinions of two distinct clinical specialties is offered. (shrink)

All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

We present a one per cent measurement of the cosmic distance scale from the detections of the baryon acoustic oscillations in the clustering of galaxies from the Baryon Oscillation Spectroscopic Survey, which is part of the Sloan Digital Sky Survey III. Our results come from the Data Release 11 sample, containing nearly one million galaxies and covering approximately 8500 square degrees and the redshift range 0.2 < z < 0.7. We also compare these results with those from the publicly released (...) DR9 and DR10 samples. Assuming a concordance Λ cold dark matter cosmological model, the DR11 sample covers a volume of 13 Gpc3 and is the largest region of the Universe ever surveyed at this density. We measure the correlation function and power spectrum, including density-field reconstruction of the BAO feature. The acoustic features are detected at a significance of over 7σ in both the correlation function and power spectrum. Fitting for the position of the acoustic features measures the distance relative to the sound horizon at the drag epoch, rd, which has a value of rd,fid = 149.28 Mpc in our fiducial cosmology. We find DV = at z = 0.32 and DV = at z = 0.57. At 1.0 per cent, this latter measure is the most precise distance constraint ever obtained from a galaxy survey. Separating the clustering along and transverse to the line of sight yields measurements at z = 0.57 of DA = and H =. Our measurements of the distance scale are in good agreement with previous BAO measurements and with the predictions from cosmic microwave background data for a spatially flat CDM model with a cosmological constant. © 2014 The Author Published by Oxford University Press on behalf of the Royal Astronomical Society. Only gradually did Sorel come to seek his paragons of virtue among the proletariat, partly because of his disillusionment with Jean Jaur~s over the Dreyfus case. Sorel had been one of the first to champion Dreyfus, but felt that demagogues had transformed the latter's cause into a new dogmatism and a new establishment. Sorel was genuinely concerned about some of (...) the deepest problems facing modern industrial man. He could not believe that they could be solved, either by "demagogic plutocracy" or by orthodox Marxism. Hence he sought to synthesize Vico, Proudhon, Marx, and Bergson in a new movement that should be both liberal and revolutionary and heroically virtuous. The strongest influence upon his thinking, says Goriely, came from Vico, from whom he borrowed "the fundamental idea of his whole work: "Man does not know what he does' " (105). History can therefore be rational only after it has happened: "The future is the field in which we use our imaginations, not our understandings" (109). That Sorel anticipated many twentieth-century developments in philosophy and politics, there can be no doubt. The author says that he was "the first philosopher in France who sought not only to locate man in history and society, but also to locate history and society in man, to give them a significance which may be called existential" (148). Before William James's pragmatism reached European shores, Sorel had made such statements as "Science is a means of verifying the possibility of acting in a certain manner." 1Even some of his pessimistic fears anticipated such developments as Burnham's "managerial revolution," at the same time that he welcomed the growth of industrial techniques in other hands (155). Professor Goriely's careful tracing of Sorel's profusion of suggestions for the ethical redemption of mankind in a machine age reveals the unreconciled contradictions in his pluralism. In the R~[lexions he could resolve the conflicts of myth versus utopia, force versus violence, liberalism versus absolutism, says Goriely, only "'by a conceptual jugglery.., which sets the mind's teeth on edge rather than stimulates it" (200). In this volume alone there are concise, clear, scholarly expositions of the important ideas of more than fifty philosophers, including biographical information and bibliographical references. The style is exceptionally intelligible and the organization of even complicated materials is well defined with good headings and with definitions that are intelligible 280 HISTORY OF PHILOSOPHY even to a layman. The work is not only very informative but amazingly objective and dispassionate. And despite its disinterestedness it is highly interesting, for it succeeds in presenting each philosopher's ideas as one imagines he would like to present them himself, sympathetically and persuasively. One leaves the book after reading about the achievements of our own little century marvelling at the variety and range of recent achievements. For over and above our follies and horrors, these thinkers emerge as men trying hard and ably to be sane and tell the truth. She shows in detail how Peirce tried at first (1868) to relate his three categories to the Scotist, Scholastic, concepts of "essence" and "substance," (...) and how, in his various phaneroscopic experiments, he gradually repudiated the Scholastic languages and by 1902 was ready to interpret his three categories as an adequate ontology. What led Peirce in this direction was his critique of perceptual judgment. He realized that subject and object are in dynamical, social, and historical relation to each other. Mauchaussat finds significant elements of the later development even in his earliest works. The documentation and exposition are detailed and precise. The figure of Lachelier emerges as an important historical link between the romantic idealism of the early nineteenth century and the objective value theory or "philosophie de l'esprit" of the twentieth. Since a category is a type of concept, it appears from this account that Kant holds a linguistic theory of concepts in general. According to Bird, Kant identifies concepts with language (pp. 61, 121, 123-124); they are, for him, linguistic entities (pp. 100, 104). On one occasion he refers to Kant's theory as a "picture of language" (p. 102). Kant seems thus to (...) be transformed by Bird into an ordinary language nominalist--and that a century and a half before Wittgenstein. The trouble with all this is that it simply is not supported by the text. Rather than giving a linguistic interpretation of concepts in general and categories in particular, Kant constantly analyzes them in conceptual terms. He speaks of them as forms of thought, ideas, conditions or criteria of thought, acts of pure thought, and so on. Their origin is always the human understanding. But, as Bird states in the passage quoted, Kant believes that our language sets a limit to our understanding. This might be taken to mean that language controls our thought so that we can conceive only what we can verbally describe. Or it could have a stronger meaning--that thought is reducible to verbalization. Bird seems to accept the latter as the proper interpretation of Kant for he contends that Kant holds the view that to conceive something is to describe it linguistically (pp. 127-129). If these words are to be understood in their ordinary meanings, one seems forced to the conclusion that in Bird's mind Kant is a linguistic behaviorist. If this is what Bird means to imply, it hardly seems worthwhile to pursue his linguistic reformulation of the critical philosophy any further. The importance of Chauncey Wright in the history of American philosophy is being increasingly realized. Professor Madden's work is the first comprehensive account of his life, his writings, and his ideas. The sources are scanty and often obscure, but Madden has made exhaustive use of them and gives us a bibliography and critical notes. This is a product of first-class scholarship, bringing together what the author had published in scattered BOOK REVIEWS 263 articles, and supplementing his anthology of Wright (Liberal Arts Press). The biographical chapter presents Wright as an attractive character among devoted friends and also as a solitary, original scientist. Wright's primary achievement was to apply utilitarian principles to Darwinian natural selection theory. Since Darwin himself made no such attempt, nor did John Stuart Mill, and since Darwin showed an evident interest in Wright's attempt, this represents a major contribution to evolutionary theory. On the negative side, too, Wright was incisive in his criticisms of Spencer, Mivart, Hamilton, Mansel, and Lewes. The pragmatic strains in Wright's philosophical method were incidental to his primary interest in showing that sciences are metaphysically "neutral." But his influence on Peirce and James was direct and strong, both on their cosmological and methodological doctrines. He deserves to be mentioned as the prime mover in this trinity of early pragmatism and naturalism, but since his own writings were relatively few and scattered, his historical importance rests largely on the use which Peirce and James made of his ideas and the development which they gave to his philosophy. But at the same time, it must be said that the degree of absorption which the essays reveal has about it an air of quaintness, as if, in reading them, one had suddenly discovered a community of people who spoke nothing but Elizabethan English. For the (...) problems constructed and dealt with in this way emerge from some earlier philosophical clime: from the worlds of Meinong's Investigations Into the Theory of Objects and Russell's Lectures on Logical Atomism, where the talk is of "elementary propositions," "The Ideal Language," "bare particulars," "denoting," what "subsists" as distinct from what "exists," and so on. If any of the writers are aware of the contributions made to philosophy by the later Wittgenstein (mentioned briefly only once in the text, p. 89), Wisdom (not referred to at all), Austin (who appears in a footnote as a translator of Frege), Ryle (mentioned once), and Strawson, this awareness is suppressed with a ruthlessness that borders on perversity. Here are gathered critical, empirical reports from competent scientists and other savants, including the whole range and all the domains of knowledge, on the concrete aspects of experience which special fields and methods of knowing reveal. Viewing experience from this wide perspective, and including in it what the Germans have called Erlebnis in order to do justice to the empirical aspects of existentialism as well as of phenomenology, these scholars have performed a basic service for the sciences and for philosophy. In addition to the more traditional distinctions between cognitive, moral, aesthetic, and religious experience, there are illuminating accounts of geological and biological empiricism (relating the terrestrial sciences to nuclear and cosmic sciences), and of experience englobante as distinguished from experience objective. The relationship between humanity and the soil is an increasingly important topic in social theory. However, conceptualisations of the soil developed by anticolonial thinkers at the high point of the movement for self-determination between the 1940s and the 1970s have remained largely ignored. This is a shame, not least because theorists like Eric Williams, Walter Rodney, Suzanne Césaire and Amílcar Cabral were concerned with the soil. Building on recent work on human-soil relations and decolonial ecology, we argue that these four (...) thinkers conceptualised the connection between soil, empire, and anticolonial revolt. Williams and Rodney ground understanding of soil degradation in global relations of economic power, while Césaire and Cabral reconceptualise postcolonial nationhood in terms of the mutability and diversity of the soil. The article concludes by suggesting that these two anticolonial counterpoints, global connectivity and more-than-human identification, anticipate and deepen contemporary attempts to decolonise ecological thinking. Over the last several decades there has been an increase in the amount of research conducted concerning academically dishonest behaviors at the undergraduate level. However, this research and subsequent interventions are based on the assumptions that there exists a clear understanding of what constitutes academic dishonesty. In an attempt to address this gap in the current literature, a concept synthesis of students’ perceptions of academic behavior was completed. The end result was 18 categories of potentially dishonest academic behaviors. Definitions and (...) examples are explored. Inter-rater reliability was completed and Kappa values are reported as well as implications for teaching and future research. (shrink)

In this paper I argue that warrant for Lewis’ principle of recombination presupposes warrant for a combinatorial analysis of intrinsicality, which in turn presupposes warrant for the principle of recombination. This, I claim, leads to a vicious circularity: warrant for neither doctrine can get off the ground.

We recall some of the early occurrences of the notions of interactivity and symmetry in the operational and denotational semantics of programming languages. We suggest some connections with ludics.

We look at a hierarchical arrangement of ideals in an MV -algebra. The principal classes of ideals studied are the maximals, the primes, the local and perfect ideals and the semi-locals. Beyond these special classes of ideals are the general ideals. Herein we study some relationships among these classes and, more specifically, the products of ideals of these classes. Among the results obtained are the square of a prime ideal is a local ideal, the finite product of prime ideals is (...) a semilocal ideal. We also show that the set of local ideals shares many of the properties of the class of prime ideals, as the Lying Over Theorem and the Going Up Theorem. (shrink)
